Having spent more than my fair share of time in the court since my divorce, I have had many conversations with other men and attorneys. Each and every one of them says the same thing, about our local court, "every man that walks in here has a target on his back".

 

If justice is blind, why do I hear this as often as I do? Don't tell me that the guys are all deadbeats and that the women all have better attorneys. I know that this is not true and my life has proven that. If her attorney was so good than how did I get the deal that I did? I was the one that negotiated the deal with her attorney while my attorney sat at my side. I came close to having her pay me alimony, but was told to back off because we had gotten everything that we had set out to get. I was told that afterward by my attorney that I had gotten the best deal he had every seen a man get.

 

My attorney did draft the custody agreement but I modified it heavily to be fair to all parties involved. I caught things that would have given one or the other parent a greater time with my son. Grandparents were given consideration, as was where he would attend school.

When my divorce took place, shared parenting was so new that there were no examples to work from. Howard Calhoun, sir, you did a beautiful job. We broke new ground and I want to keep breaking it.

 

In the past in this county, the only way that a man got more than the typical weekend visits was if the mother was a drug addict or in jail. Even then it was not a sure thing for the man. Men walked in and gave up their rights because they were told that they didn't stand a chance because the courts sided with the mother no matter what was in the best interest of the children.

 

I want someone to explain to me why the judges keep siding with the mothers. Federal law prohibits discrimination because of race, handicap or sex. How can a domestic relations judge get away with allowing their bias to influence their decisions? How can a domestic judge get away with failing to follow the Constitution that they are sworn to up hold? Read the oath you took when you were sworn into office. If the bias doesn't exist, then open the records and prove it.

 

I know this bias is real within the court and their support system. In a resent interview with a Family Court Services Evaluator, I saw it in person. In a recent meeting with Family Court Services, my ex offered me a standard custody agreement with her as the primary parent. I said no. I was told to make her a counter offer. I offered her the same thing that she had offered me but with me as the primary parent. The evaluator exclaimed, "That is less than she has now!" What? A man can be offered less and it is all right but if she is offered less then it is wrong. That is sexual bias. If it exists at that level of the court then it exists at all.

 

And you as judges have proved that you also have biases that should not exist by allowing false testimony to be entered and fathers to be forcibly separated from their children. Take the case of Kevin Rice, falsely accused of child molestation. He has presented evidence to you that these are false, yet you still refuse to allow him to visit his children. You refuse to put his accuser through the same hoops that you have him. When are you going to follow the law and respect the truth? Yet you claim to be acting in the best interests of the children. How are the best interests of a child being served when you allow false testimony and forbid a father from seeing his children?

 

It is time to put and end to this now!

 

Can we say due process in Domestic Relations Court in Summit County, or is railroading and total disregarding of the integrity of the judicial process and the constitutional rights of parents the standard operating procedure?

 

Got no big surprise here, they can not say due process even with a visiting judge that we were informed was supposed to be a man of integrity. WRONG! A PACE Member had a hearing today that was totally illegal, in the fact that the visiting judge (Joseph E. Cirigliano of Lorain County [I would have put Honorable before his name but he isn't so why waste the ink]) that had the 'hearing' and ruled on his own recusal. Failed to allow the Plaintiff to present any witnesses or enter his own testimony. Failed to allow the plaintiff a recess to retrieve files so that the 'illegal trial' that was not supposed to be happening in the first place could continue with him presenting evidence (8000+ pages) and witnesses. This being a trial that should not have taken place, because of the recusal that have yet to be ruled on and was docketed for three days. See you in a higher court.

 

With actions such as this in the court system does anyone wonder why there is a Constitutional Challenge to the Ohio Custody law? Why they has been a federal suit filed in US District Court in Cleveland for endangering a child with processes such as this and failing to support the Constitutional Rights of every parent.

 

And add to this the troubles that Summit County has at present with Children's Service Board workers that have gone out on strike and what , probably, will be a multi-million dollar lawsuit for the endangerment of six children that were locked in a closet by two lesbian lovers and fed animal feces. Can't say for sure that they will be sued but in the eleven times that CSB has been taken to court since 1990, they have failed to win a case. Oh, wait CSB said that these children were just fine and healthy. Akron Police said the same but admitted that they failed to do a wellness check on all the kids (CSB did like wise) and actually testified in Domestic Relations Court on behalf of the mother. Even if they had testified AGAINST the mother the Magistrate would have ruled in her favor any way and stated on the record that she didn't believe them.

 

Same magistrate refused to allow a Guardian Ad Litem report to be entered into the record because "it was too favorable to the father and no father is that good". These kids now live in a trailer park in South Carolina and the last time the father saw them, he had to give them a bath before driving them back to Ohio.

 

Or how about the other father that has filed numerous contempt citations in your court and you have yet to find the mother in contempt or ruled on the father's motions, yet you didn't hesitate to find him in contempt on the only motion the mother filed. Oh and thanks for using that little know section of the Ohio revised code that allows you to change a custody order on your own. I made sure it was out in HB232.

 

Hey, Magistrate Debra Matz, where did you earn your law degree and did you forget to read OH REVISED CODE 3109.03? I highly suggest that you read it and learn it fast.

 

Let's not forget Magistrate Janice Gui who thinks that an eight year old should be held responsible for her father, an illegal immigrant, and is to make sure that he is not drunk when he has her in his possession. By the way Janice, I checked the court records, where is the contempt citation for his failure to pay child support for that same child?

 

Hey Judge Carol Deszo! Hey Judge John Quinn! Hey retired judge Judy Nicely! Wonder why there is a PACE chapter in Akron and why we have repeatedly called for a full investigation of your court? Thats OK, if your other political cronies want to cover for your lack of judicial integrity because that report is coming. Like it or not.

 

Like it or not, your time is at an end. There was one judge removed from the bench here not too many years ago. I promise you that you two will be the next. As will any other politician that refuses to do the right thing. Summit County Prosecutor Sherri Bevan Walsh, your time has come too for failing to uphold your responsibilities to the citizens of this county. You have has numerous complaints filed with your office over the perjury and fraud committed at DRC and yet you have failed to address the crimes. Thought that was the job of a prosecutor. But evidently, you don't think that this matters, nor do judicial issues and misconduct.

 

This is war and you can consider this my shot across your bow. It is the only warning that you will receive. I have made every attempt possible to develop a working and co-operative relationship with you. You have refused! The war is on and the next time, I will sink all of you.
